of injuries

When you sue for personal injury or wrongful death, your lawsuit may be filed in state or federal court, depending on the specific facts of a case. Our attorneys are admitted to practice in all state and federal courts. However, many cases can be settled to the satisfaction of both parties before trial, and our attorneys have extensive experience in negotiating successful resolution of personal injury claims without the need for expensive and time-consuming litigation.

Our success in early resolution of claims helps to prevent further damage from delay, and much of the credit belongs to our knowledge of the law and our ability to quickly obtain necessary information, documents, and experts.

Recovering damages will depend in part on the terms of your insurance policy. It’s important first to understand what you are covered for and what your actual costs are likely to be given the scope and nature of your injuries. You may even be denied insurance benefits under a policy that actually covers your situation. Therefore, it is of critical importance that you have your case reviewed by professionals on a timely basis. Delay can also completely prevent you from pursuing a suit, since Mississippi and Tennessee each have a statute of limitations.

Car accident lawyer

Car accidents

Simmons Dallas, PLLC, represents people injured in car accidents throughout Mississippi and Tennessee caused by the negligence or recklessness of other drivers.

Contact our attorneys to schedule a free initial consultation. Our focus is on protecting your interests, whether that is recovering full and fair compensation for your serious injuries, or defending you against a nuisance suit filed by someone else involved in an accident.

Car accidents, whether they are with another car, a truck, or a motorcycle, are terrifying and can potentially cause serious injury, including:

  • Traumatic brain injuries

  • Spinal cord injuries, leading to paralysis

  • Closed-head injuries

  • Crushed or broken bones

  • Soft-tissue injuries, including whiplash

You deserve to be compensated for what someone else’s careless driving has caused; in addition to property damage, past and future medical expenses and lost wages, you may also be able to recover damages for pain and suffering.

Often, personal injury cases can be settled without having to go to the expense of trial. Our attorneys are extremely experienced negotiators and investigators — we will quickly obtain all of the necessary information, including experts, so that we may successfully seek fair compensation on your behalf. Our success in early resolution of claims helps to prevent additional damages caused by prolonged litigation. Success also depends on you. It is extremely important for you to:

  • Take pictures of the accident and your injuries, if possible

  • Report all injuries and changes in your condition to your doctor, even if you think it is not related to your accident

  • Not give a statement to your employer or to your insurance company without legal representation

Unfortunately, it is common for your insurance company to deny insurance benefits even when you are covered. For this reason, it is crucial that you obtain attorneys experienced in working with insurance companies as soon as possible.

Premise Liability

Premise liability

At Simmons Dallas, PLLC, our lawyers represent people who have sustained slip-and-fall injuries while on someone else’s property or caused by a third parties’ animal or pet.

To schedule a free initial consultation, contact our injury lawyers. It is our goal to protect your rights, including obtaining full and fair compensation for the damages caused by your injuries, and protecting your home against false insurance claims.
Our premises liability attorneys can assist you in recovering damages for injuries sustained on an individual or commercial property due to:

  • Negligent security

  • Slip-and-fall accidents caused by improperly maintained property or homeowner negligence

  • Dog bites/animal attacks

Under Mississippi and Tennessee law, the compensation to which you are entitled when you are injured on someone’s premises depends on the relationship you had with the property owner at the time of your injury. What you were doing or how you came to be on their property at the time of your injury is an important aspect that needs to be considered by competent legal counsel experienced at handling these kinds of personal injury claims.

For example, you are owed a higher level of care by a storeowner in whose store you are shopping than you are owed as a guest invited into the home of the property owner. If you are trespassing at the time you are injured, the property owner is only responsible for damages caused by an extreme lack of care, such as failure to fix or mark an open hole.

Product Liability

In a product liability lawsuit, answering the question of whether reasonable precautions were taken is a highly technical process. The factors involved will vary greatly depending on whether the product in question is a drug, a safety device, or an ordinary appliance. Legal actions for product liability are complex to say the least. Our experts’ extensive knowledge of manufacturing, testing and marketing processes provides invaluable support to Simmons Dallas, PLLC in the review and successful resolution of product liability cases. Our skilled product liability attorneys will be able to find the right technical experts to clarify the proper standard of care.

Our personal injury attorneys possess decades of experience in litigating defective medical device cases. Assisted by a team of in-house physician and registered nurse consultants, our attorneys provide each client with high-level, individual representation.

Toxic chemical litigation

Simmons Dallas, PLLC, represents people who have been improperly exposed to toxic chemicals, such as propyl bromide. We have a dedicated team of attorneys, paralegals and industry specialists who have extensive experience in determining the type and amount of exposure to 1-bromopropane and other chemicals, the harmful results of exposure, and the ability to prove the medical causation between the improper exposure and the resulting physical damage.

We utilize a team of experts including toxicologists, neurologists and industrial hygienists to assist in the investigation and prosecution of claims against companies that have exposed individuals to a variety of toxic chemicals without adequate ventilation and/or skin, eye or respiratory protection.

If you have been exposed to a toxic chemical, or if you have suffered an injury or suspect you may have been injured or damaged as a result of improper exposure to a toxic chemical, you should contact our attorneys immediately about your toxic chemical litigation. Failure to act could result in further damage, and the loss of your legal right to bring your claim.

Propyl Bromide

Propyl bromide

Our team has a reputation for success in recovering compensation for damage caused by overexposure to toxic chemicals. For example, we recently recovered a $9.9 million verdict against parties that had exposed our clients to propyl bromide. Propyl bromide, also known as 1-bromopropane or n-propyl bromide, is a chemical that has been used extensively in the furniture industry as a spray adhesive and in the industrial cleaning industry as a degreasing solvent and metal cleaner.

Some trade names of the products that contain 1-bromopropane and are used as degreasers for industrial cleaning, and may be in adhesives used in furniture manufacturing, are as follows:

  • Hypersolve

  • ABZOL

  • Lenium

  • Contact Cleaner – NPB Heavy Duty

  • No Flash Nu Electro Cleaner

  • Heavy Duty Degreaser II

  • 1640 Bulk

  • Whisper Spray (Imperial Adhesive)

  • Fire retardant Soft Seam 640 (Mid South Adhesive)

When improperly used, propyl bromide can cause serious physical damage to the central nervous system and the reproductive system. Further, 1-bromopropane has been shown to cause extensive skin and/or eye irritation, and multi-organ damage, including liver and kidney damage. It can enter the body if swallowed or if it comes into contact with the skin, and also if the vapor is breathed in. If the hands are contaminated, it can be swallowed following hand to mouth contact.

If you or someone you know has been exposed to 1-bromopropane (or sometimes referred to as simply bromopropane or propyl bromide), or another toxic chemical, you may experience one or more of the following symptoms:

  • Headaches/dizziness

  • Nausea

  • Feeling of being drunk/high

  • Numbness

  • Tingling or loss of sensation in extremities

  • Memory loss

  • Laryngitis

  • Peeling skin

  • Unable to walk/ataxic gait

  • Perineal numbness/vaginal numbness

You do not have to suffer in silence — we are here to help.

Simmons Dallas, PLLC, represents people who have been improperly exposed to propyl bromide. We have a dedicated team of attorneys, paralegals and industry specialists who have extensive experience in determining the type and amount of exposure, the harmful results of exposure, and the ability to prove the medical causation between the improper exposure and the resulting physical damage.
